Public Law Outline (PLO)

The Public Law Outline (PLO) is a legal framework used by local authorities to manage care proceedings, ensuring decisions regarding a child’s welfare are made within a set timeframe. We guide you through the PLO process, helping you understand each stage and ensuring the child’s best interests are always at the forefront, whether through pre-proceedings or court proceedings.

Interim Care Order (ICO)

An Interim Care Order is a temporary court order that places a child in the care of the local authority while further decisions are made about their future. We provide guidance through the process, helping you understand its implications and challenging the order if necessary, to ensure the best temporary solution for your child’s welfare.

Special Guardianship Orders

A Special Guardianship Order grants a person (usually a family member) parental responsibility for a child. This order is often sought when a child cannot live with their birth parents but needs a stable, long-term home.

Legal Aid for Care Proceedings

If the local authority is considering involvement through care proceedings or is currently involved, you are automatically eligible for legal aid. We can also assess your situation and assist you with applications for legal help under the Public Law Outline, ensuring you receive the necessary funding for your case.

We offer Legal Aid services

If you are a parent or someone who holds parental responsibility for a child involved in care proceedings, such as a care order or supervision order, you will automatically qualify for legal aid. This includes cases involving emergency protection orders and child assessment orders. Regardless of your income or the likelihood of success, all parents are entitled to legal aid in these situations.

Legal aid is also available for other public law applications, such as secure accommodation orders, contact with a child in care, discharge of care orders, variation of supervision orders, and adoption. However, these applications are means and merits tested. This means the Legal Aid Agency will assess your income and the likelihood of success in your case. Legal aid is typically only available to those on a low income, ensuring that access to legal representation is available to those who need it most.

Answers to commonly asked questions about our services where there is Local Authority involvement: 

  • Care proceedings are court proceedings initiated by a local authority's children's services department to apply for a Care Order or Supervision Order for a child, typically when they believe the child is at risk of significant harm.

  • Care proceedings will be initiated if children's services believe a child is suffering or at risk of suffering significant harm, as outlined in Section 31 of the Children Act 1989. This happens when they believe the child can no longer remain safely at home.

  • A pre-proceedings meeting is an attempt to avoid court intervention by addressing concerns about the child's safety. It is the final step before care proceedings are initiated, where parents are informed of concerns and what needs to change to prevent further action.

  • Yes, legal aid is available for parents and others with parental responsibility for the child. It is available regardless of income or the merits of the case if parents receive a "letter before proceedings" or "letter of issue."

  • The child's parents and anyone else with parental responsibility are considered parties to the proceedings and have the right to attend all court hearings. Others can apply for permission to be added as a party in proceedings.

  • Care proceedings must be concluded within 26 weeks from the date the application is issued, according to Section 14(2) of the Children and Families Act 2014, to ensure that decisions are made without delay.

  • An Interim Care Order is a temporary court order that allows children's services to remove a child from the care of the parents before the final hearing. It can last for up to 8 weeks and is decided at a court hearing where parties can make representations.

  • The Case Management Hearing is held to set directions for the case, including identifying key issues, necessary evidence, and whether there is a real issue about the threshold to be resolved. It ensures the case is ready for the final hearing.

  • An Issues Resolution Hearing is held to determine if care proceedings can be concluded early or if issues can be narrowed down for the final hearing. It is often used to resolve or identify key issues, such as where the child should live and contact arrangements, before the case proceeds to a final decision.

  • The court can issue several final orders, including a Care Order, Supervision Order, Special Guardianship Order, or Placement Order, depending on the child's needs and welfare. Each order has different implications for where the child will live and the involvement of the parents.
